Terms of Service

These Terms of Service ("Terms") govern your use of CashPilot, a business management application provided by Tobiz Network Sdn Bhd (Registration No. 201701036845 / 1251016-T)("Company," "we," "us," or "our"). By using CashPilot, you agree to these Terms.

1. Service Description

CashPilot is a Progressive Web App (PWA) designed for small and medium enterprises (SMEs) in Malaysia. It provides financial management tools including transaction tracking, invoicing, payables, receivables, and digital order book features.

2. Eligibility

CashPilot is intended for business use by individuals aged 18 and above. By using CashPilot, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms.

You retain ownership of the business data and information you enter, create, upload, or store in CashPilot ("Your Data"). CashPilot does not claim ownership of Your Data or use it to establish ownership rights over your business information.

CashPilot is designed with a local-first approach. Depending on the features you use and your account status, Your Data may be stored locally on your device using browser storage technologies such as IndexedDB and may be synchronized with CashPilot's cloud services under your authenticated account.

CashPilot may use third-party cloud infrastructure, databases, object storage, content delivery networks, and other hosting services to operate, process, synchronize, store, protect, and deliver certain CashPilot features. These services may change from time to time as CashPilot's infrastructure develops.

Certain CashPilot features may use third-party services, including Google Drive, when you choose to connect and use such services. Files stored in your Google Drive remain subject to your Google account, Google Drive settings, and Google's applicable terms and policies.

When you use CashPilot's Google Drive backup feature, CashPilot may create or update backup files in the Google Drive location authorized by you. CashPilot does not claim ownership of those backup files. You are responsible for maintaining access to your Google account and ensuring that your Google Drive has sufficient storage and remains available for your intended use.

CashPilot may retain limited technical, account, or synchronization information required to operate and provide its features. The handling of personal information is described separately in the CashPilot Privacy Policy.

You are responsible for the accuracy, completeness, security, and lawful use of Your Data. You are also responsible for maintaining appropriate backups of Your Data. CashPilot does not guarantee that data stored locally on your device, synchronized to CashPilot's cloud services, or backed up to third-party services will always be available, complete, or recoverable.

We strongly recommend that you regularly use the available backup features and maintain copies of important business records in a location under your control.

If you delete Your Data, uninstall CashPilot, clear your browser storage, lose access to your device or account, or otherwise remove locally stored information, some data may not be recoverable unless it has previously been synchronized or backed up. You are responsible for ensuring that important business records have been backed up before taking such actions.

6. Paid Features and Payments

CashPilot may offer optional paid features, packages, subscriptions, or other paid services ("Paid Features") from time to time. The applicable price, billing period, and features included will be presented to you before you complete a purchase.

By purchasing a Paid Feature, you authorize CashPilot or its designated payment service provider to charge the applicable amount using the payment method selected by you.

Unless otherwise stated at the time of purchase or required by applicable law, payments for Paid Features are non-refundable once the Paid Feature has been activated or made available to you. Cancellation of a Paid Feature does not automatically entitle you to a refund for any amount already paid.

Where a Paid Feature is provided on a recurring subscription basis, cancellation will generally prevent future charges or renewals, while your access may continue until the end of the applicable paid period.

CashPilot may, at its discretion, provide a refund or credit in circumstances such as duplicate charges, billing errors, or significant service issues. Any such refund or credit does not create an obligation to provide similar refunds in the future.

If a payment is reversed, disputed, charged back, or otherwise not successfully completed, CashPilot may suspend or terminate access to the affected Paid Features until the outstanding amount is resolved.

CashPilot may change the pricing or availability of Paid Features from time to time. Any price changes applicable to an existing recurring subscription will be communicated in advance where required by applicable law.

CashPilot, including its design, code, branding, and documentation, is the property of Tobiz Network Sdn Bhd. These Terms do not grant you any rights to our intellectual property beyond the right to use the service as intended.

11. Disclaimer of Warranties

CashPilot is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or suitable for any particular business purpose. CashPilot is not a substitute for professional accounting or financial advice.

12. Limitation of Liability

To the maximum extent permitted by law, Tobiz Network Sdn Bhd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of CashPilot, including but not limited to loss of data, loss of revenue, or business interruption.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of CashPilot after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising from or relating to these Terms shall be subject to the jurisdiction of the courts of Malaysia.
